Difference Between Form 15CA and 15CB:
1.Purpose:
Form 15CA is a declaration by the remitter, used to collect information on payments made to non-residents and ensure tax compliance under the Income Tax Act.
Form 15CB is a certificate from a Chartered Accountant (CA) that certifies the details of the remittance, including the applicable tax rates and provisions under Double Taxation Avoidance Agreements (DTAA).
2.Who Requires It:
Form 15CA is required for any person making a remittance to a non-resident, except in cases specified under Rule 37BB where no submission is necessary.
Form 15CB is required only when the remittance exceeds ₹5 lakh in a financial year and is taxable under the Income Tax Act.
3.When to Submit:
Form 15CA must be submitted before the remittance is made to the foreign party.
Form 15CB is obtained before filing Form 15CA, as details from 15CB are needed to complete 15CA.
4.Applicability Based on Remittance Amount:
For remittances less than ₹5 lakh in a financial year, only Form 15CA (Part A) is required.
For remittances above ₹5 lakh, Form 15CA (Part C) along with Form 15CB is required, unless exempted.
5.Tax Deduction Confirmation:
Form 15CA confirms that the applicable taxes have been deducted and paid.
Form 15CB ensures that the correct tax has been deducted as per the provisions of the Income Tax Act and DTAA, certified by a CA.
6.Exemptions:
No Form 15CA/15CB is required for transactions specified under Rule 37BB (like payments for imports, travel expenses, etc.).
